By downloading, installing, or using NoteThing ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal or business use on devices that you own or control. A single App Store purchase grants you use of the App on iPhone, iPad, and Mac through Apple's Universal Purchase program.
You agree not to:
All notes, tasks, goals, reminders, and other content you create in NoteThing belong to you. We do not access, scan, claim ownership of, or otherwise interact with your content. Your data is stored locally on your device and, if you enable iCloud Sync, in your private iCloud account managed by Apple.
You are responsible for backing up your data. We strongly recommend enabling iCloud Sync and/or iCloud Backup on your devices so your content is preserved even if a device is lost or damaged.
The App and all its design, code, branding, and other proprietary elements are owned by Core Dump Software LLC and are protected by international copyright, trademark, and other intellectual property laws. Your content is yours; the App itself is ours.
If you download the App from the Apple App Store, you acknowledge and agree that:
NoteThing offers optional iCloud Sync via Apple's CloudKit service. When enabled, your content is transmitted between your devices using your iCloud account. This service is provided by Apple and subject to Apple's terms and availability. We are not responsible for iCloud service outages, sync delays, or other issues caused by Apple's infrastructure.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that data will sync without delay or loss.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CORE DUMP SOFTWARE LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
All purchases are processed through the Apple App Store. Refunds are subject to Apple's refund policy. We do not have access to your payment information or the ability to process refunds directly. Please contact Apple Support for refund requests.
We may update the App from time to time to add features, fix bugs, or improve performance. These updates may be automatic or may require you to manually update through the App Store.
We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.
We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms. Upon termination, you must cease all use of the App and delete all copies from your devices. Your locally-stored content remains yours.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
